JSI is committed to protecting our visitors’ privacy. This policy describes how we collect, use, maintain, protect, and disclose the personal information we collect on SkillBlox. Please read this policy carefully to understand our policy and practices regarding your personal information. 

Your Consent

By accessing or using the SkillBlox website you agree to and understand this privacy policy.

Information Collection

We may collect personally identifiable information, such as your name, e-mail address, postal address, or phone number when you provide it. In some instances (e.g., job applications, pay online), we may also collect other information such as your username, and password. We may receive information about how and when you use our sites and store it in log files. This information might include, for example, your IP address, time, date, browser used, and actions you have taken within the site. We may receive information about how you use our newsletters and other features you may subscribe to, such as whether you opened a message, what articles you viewed, and similar information.

We maintain one or more public blogs on our websites. Any information you include in a comment on our blog may be read, collected, and used by anyone. If your personal information appears on our blogs and you want it removed, contact us at jsinfo@jsi.com. If we are unable to remove your information, we will tell you why.

Our websites include social media features, such as the Facebook or Instagram button. These features may collect information about your IP address and which page you are visiting on our website, and they may set a cookie to make sure the feature functions properly.

We also maintain presences on social media platforms, including Facebook, Twitter, LinkedIn, YouTube, and Instagram. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them. Any information or material you submit to us via these or other social media platforms is done at your own risk without any expectation of privacy.

JSI collects email addresses of people who communicate with us by email.. Email addresses are also collected when you sign up to receive our email newsletters or updates from our blogs. JSI never sells, trades, or rents email addresses to other individuals or companies.

Information Use

The personal information we collect is used to provide the services or products that you have requested, to help improve our websites, and to manage and improve communications with you and all of our users. We also use the information we collect to respond to your requests.

Information Retention

We will retain personal information only for as long as needed to provide our products or services, to manage our business, or to comply with legal obligations, resolve disputes, prevent abuse, and enforce our agreements.

Information Sharing

We may share personal information with companies, organizations, or individuals outside JSI if we have a good-faith belief that sharing the information is necessary to:

• meet any applicable law, regulation, legal process or enforceable governmental request.

• enforce applicable Terms of Use or other potential violation of contracts or rules, including investigation of potential violations.

• detect, prevent, investigate or otherwise address fraud, security, or technical issues.

• protect against harm to the rights, property or safety of JSI, our staff, our users or the public as required or permitted by law.

We may also share your personal information with organizations or individuals we contract with to help us provide our services and products. Before sharing your personal information with any organization or individual we contract with, we will require they protect your information in a manner consistent with this policy.

Other than the cases listed above, your personal information is never shared with outside organizations or individuals. JSI staff have access to your personal information only as required to accomplish the purpose for which it was collected.

Registration Forms

Our site’s registration form requires users to give us contact information. Use of this information is strictly for JSI and affiliated companies. JSI will not share this information with others without the applicant’s consent. Once the information reaches JSI, access to the applicant’s information is restricted to JSI and affiliate staff. JSI treats personal identifications, if provided, at the highest level of confidentiality and makes these only available to a few selected staff.

Contact information from the registration forms is used to get in touch with the applicant when necessary.

Data Quality/Access

This site gives users the following options for changing and modifying information previously provided:

To change information after data have been entered for the first time, simply log into using your user name and password. Access to the information is available through any Internet connection and at any time, barring periodic maintenance and any technical difficulties beyond JSI’s control.

Cookies and Web Beacons

We use cookies to collect non-identifying information about you as a user, such as Web-surfing behavior or user preferences for a specific website. Cookies are small text files that are downloaded by a browser when a site is visited. Cookies are returned to an originating site and/or third-party site on subsequent visits. Cookies may serve several functions, including remembering user preferences, visited pages, time and dates, and other metrics. JSI does not link information obtained through cookies to individual user’s personal information. You may disable use of cookies on this site through your browser settings. However, please be aware that disabling cookies may adversely affect the operation of some features of our sites.

We may also use small pieces of code called “web beacons” to collect such things as page views and email responses.

We use Google Analytics—a service provided by Google, Inc. Google Analytics uses cookies to allow us to see how you use our site. Google’s ability to use and share information collected by Google Analytics about your visits to our sites is described by the Google Analytics Terms of Use available at https://www.google.com/analytics/terms/us.html and the Google Privacy Policy available at http://www.google.com/policies/privacy/. We have no control over either of these Google policies, and they may change at any time.

You can prevent Google Analytics from recognizing you on return visits to our sites by disabling cookies in your browser. Google also provides an “opt-out” tool (which must be installed in your browser) which will prevent your browser from making your site activity available to Google Analytics. The Google Analytics Opt- out Browser Add-on is available at https://tools.google.com/dlpage/gaoptout. We are not responsible for this tool. If you choose to use it, you do so at your own risk.

We use cookies to create a unique identifier for you, so that you do not have to reenter your user name and password as you move from page to page within the site. We also use cookies to help us determine the number of unique individuals who have accessed our site.

The JSI Job Application Manager does not make any other use of cookies.

Security

While the security of information transmitted over the Internet cannot be guaranteed, we use commercially reasonable physical, electronic, and procedural measures to protect against the loss, misuse, and alteration of the information under our control. These measures include—but are not limited to—encrypting transmissions of personal information to or from our websites using Secure Socket Layer technology.

To prevent unauthorized access to applicant data, JSI uses a secure connection any time an applicant connects to the. Each user has a unique user name and password, which limits access to the applicant’s information to the applicant and JSI staff.

External Links

Our websites contain links to other sites, but we are not responsible for the privacy practices or the content of those sites. We encourage you to be aware when you leave our site and to read the privacy statements of any site that you visit.

Children’s Privacy

JSI’s websites are not intended for children. JSI does not intentionally or knowingly collect any information from anyone under the age of 13. If you are under 13 you should not submit any personal information to us while visiting our websites. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact jsinfo@jsi.com.

If we change this policy, we will post those changes here, on the homepage of our various sites, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

Please read these Term of Use (“Terms”) carefully before using SkillBlox, which is operated by World Education, a division of JSI Research & Training Institute, Inc. (JSI). These Terms set out the rights and obligations of all users of SkillBlox and governs your use of SkillBlox. By accessing or using SkillBlox you agree to be bound by these Terms in full. If you disagree with any part of these Terms than you may not access SkillBlox. 

Privacy Policy

Your access to and use of SkillBlox is also conditioned on your acceptance of and compliance with our Privacy Policy. Our Privacy Policy describes the ways in which we may collect, use and disclose users personal information. Please read our Privacy Policy carefully before using SkillBlox.

Registration

Registration for SkillBlox is only available to users who are at least 13 years old. If you are younger than this, please do not register for SkillBlox. If you register for SkillBlox, you represent that you are this age or older.

You will be asked to provide us private information in order to create an account with us. You are responsible for ensuring that this information is accurate, complete, and current at all times.  You are also responsible for safeguarding your password and must not disclose it to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You are responsible for any activities or actions that occur under your account, whether done so by you or any third person using your account. 

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

User Generated Content

Users may post, upload, or otherwise contribute content to SkillBlox ("User Content"). Users may also create individual “Blox” compiling content selected by the user. "User Content" includes individual user-created “Blox” and all information, materials and other content that is added, created, uploaded, submitted, distributed, or posted to SkillBlox by users.

You are solely responsible for all User Content that you post. You represent and warrant that: 1) you own the User Content you post or have the right to post the User Content and grant the license included in these terms, and; 2) your posting of the User Content does violate the copyrights, privacy rights, or any other rights of any third party.  

You retain ownership of your User Content that you post to SkillBlox. In order for us to make that User Content available on SkillBlox, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through SkillBlox. When posting your User Content, please remember that your User Content will be accessible by other users. You agree that this license includes the right for us to make your User Content available to other users of SkillBlox.  

You have the right to keep any individual Blox you create private from  other users. If you opt to keep your Blox private, JSI will not provide other users access to your Blox. However, you are also responsible for safeguarding the privacy of your Blox and must not share links or access to your Blox with others if you wish it to remain private. If you do make your Blox public, whether intentionally or unintentionally, your Blox will be accessible by other users and the above license applies.  

Interactive Content

SkillBlox may include Interactive Content that you may choose to participate in. “Interactive Content” includes webinars, quizzes, polls, surveys, evaluations, and message boards. Your participation in Interactive Content, including without limitation any recording of your image or voice, poll responses, and the text of any questions or comments you submit in writing, such as in survey or evaluation responses, may be recorded. By participating in the Interactive Content, you grant JSI a perpetual, irrevocable, worldwide license to reproduce, distribute, modify, publicly perform, publicly display, and otherwise use and exploit any content generated from your participation in Interactive Content. 

Feedback to Us

If you provide any suggestions, ideas or other feedback (“Feedback”) for improving SkillBlox or any content, you agree JSI has an unrestricted right to use, disclose, publish, keep confidential or otherwise exploit the feedback without crediting or compensating you. 

Restricted Behavior

JSI is not responsible for the User Content posted by SkillBlox’s users. You may not post any User Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such prohibited content include, but are not limited to, content that is:

• Unlawful or promoting unlawful activity.

• Defamatory or discriminatory including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.

• Spam, machine – or randomly – generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.

• Designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person. This includes content containing or installing any viruses, worms, malware, or trojan horses.

• Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights.

• Impersonating any person or entity including JSI and its employees or representatives.

• Violating the privacy of any third person.

JSI may, but has no obligation to, review and monitor User Content and, in its sole discretion, determine whether or not any User Content is appropriate and complies with these Terms. User Content you post may be reviewed by JSI or sent to third-party verification services (including, but not limited to, spam prevention services). JSI reserves the right to refuse or remove any User Content for any or no reason and may take these actions without prior notification to you. JSI can also limit or revoke the use of SkillBlox if you post prohibited content.

Because JSI cannot control all content posted by users and/or third parties on SkillBlox, you agree to use SkillBlox at your own risk. You understand that by using SkillBlox you may be exposed to content that you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will JSI be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

Termination of Account

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use. Upon termination, your right to use SkillBlox will cease immediately. 

Copyright Infringement

We respect the intellectual property rights of others. It is our policy to respond to any claim that User Content posted on SkillBlox infringes a copyright of any person. If you are a copyright owner and you believe that your copyrighted work has been copied and made available through SkillBlox please see our DMCA Policy. 

Intellectual Property

SkillBlox and its original content (excluding User Content provided by you or other users), features and functionality are and will remain the exclusive property of JSI and its licensors. SkillBlox is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of JSI.

Third-Party Websites

SkillBlox may contain links to third-party web sites or services that are not owned or controlled by JSI. JSI has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that JSI shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third-party web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Limitation of Liability

NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR, YOUR EXCLUSIVE REMEDY AND THE ENTIRE LIABILITY OF JSI ARISING OUT OF YOUR USE OF SKILLBLOX SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU THROUGH THE WEBSITE OR 100 USD IF YOU HAVEN'T PURCHASED ANYTHING THROUGH THE WEBSITE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JSI BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES OR FOR ANY LOST PROFITS OR BUSINESS ARISING OUT OF YOUR USE OF OR INABILITY TO USE SKILLBLOX (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA OR OTHER INFORMATION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, OR CAUSED BY THIRD-PARTY SOFTWARE AND/OR THIRD-PARTY HARDWARE USED WITH SKILLBLOX). THE LIABILITY LIMITATIONS IN THIS CLAUSE APPLY TO: 1) LIABILITY FOR NEGLIGENCE; 2) REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT PRODUCT LIABILITY OR OTHERWISE; 3) EVEN IF JSI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND; 4) EVEN IF THE REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SKILLBLOX IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, JSI, ON ITS OWN BEHALF AND ON BEHALF OF ITS AFFILIATES AND ITS AND THEIR RESPECTIVE LICENSORS AND SERVICE PROVIDERS, EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO SKILLBLOX, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OR TRADE PRACTICE. Indemnification

The laws of the Commonwealth of Massachusetts, USA, excluding its conflicts of law rules, shall govern these Terms and your use of SkillBlox. The parties consent to the personal and exclusive jurisdiction of the Federal and state courts of the Commonwealth of Massachusetts, USA to hear all disputes arising out of these Terms.

Amendment of Terms

JSI may change its Terms of Use and/or Privacy Policy at any time by posting a new version on this page or on a successor page. The new version will become effective on the date posted, which will be listed at the top of the page as the new Effective Date. Each time you access or use SkillBlox, you accept and agree to the then-current Terms of Use and Privacy Policy.
